Forensic Neurology
The brain and nervous system underpin the emotional, cognitive and physical behaviour of individuals. Neurology is a speciality dealing with disorders of the brain and nervous system, and neurologists are doctors who are experienced in diagnosing and managing disorders of the brain and nervous system.
Neurologists routinely see patients with a variety of symptoms including seizures, black outs, headaches, head injuries, memory loss, cognitive difficulties, sensory-motor symptoms, behavioural difficulties and involuntary movements. Many neurological conditions present with neuropsychiatric as well as physical symptoms. These conditions can include epilepsy, brain tumours, drug side effects, head injuries, functional neurological disorders, and Parkinson’s disorder amongst others.
Forensic Neurology Services
In some forensic cases a neurological assessment of a client may be relevant to assess how a known neurological condition (or hitherto undiagnosed neurological condition) may affect how the client acted and what effects those actions had (i.e. actus reus), and whether they were culpable in having acted like that (i.e. mens rea). A neurological assessment may be also useful in these circumstances to establish whether a client is a fully responsible moral agent or whether their agency is somehow diminished.
A neurological assessment will typically involve detailed history taking from a client, and relevant friends/family, and a full physical (and cognitive where relevant) neurological examination. The neurological assessment can also guide the need for further investigations such as brain imaging (CT or MRI), neuropsychology, brainwave recording (EEG) or psychiatric assessments.
